電視廣播（TVB、無線）就股份回購申請清洗豁免的裁決，向法院提出司法覆核一案，高院昨判TVB勝訴，但最終是否向TVB授出清洗豁免，仍視乎證監會收購及合併委員會的決定。TVB行政總裁李寶安指出，裁決內容屬原則性指引，仍須與證監會跟進回購安排。TVB昨早開市前停牌，停牌前報26.4元。大公報報導，TVB年初提出規模42億港元的回購要約，而在最新回購方案下，為免大股東黎瑞剛及陳國強等人觸及全購，須向證監會申請清洗豁免。惟證監會收購及合併委員會5月裁定，要求該提案在未扣減投票權的前提下獲股東大會多數票贊成，且清洗豁免不應交由TVB股東另行投票表決，方可有條件授予豁免。TVB隨後表明不認同並提出司法覆核，上月底審結候判，昨日高院公布判決結果。高院法官黃國瑛裁定TVB司法覆核勝訴，下令撤銷證監會收購及合併委員會之前對TVB回購要約的裁決。她並聲明《廣播條例》中有關外資股東的投票權扣減機制，亦適用於股東投票表決清洗豁免。至於是否批准清洗豁免，則仍發還證監會收購及合併委員會決定。據報導，TVB對高院判決「表示歡迎」。行政總裁李寶安回應稱，雖獲法院判勝訴，但裁決內容屬原則性指引，TVB未來仍須就回購的投票方式等技術安排與證監會跟進，至於證監會下一步行動，則還是未知數。他坦言有很多技術問題尚待解決，但強調目前無意放棄回購計畫。另有消息指出，證監會方面要分析判詞內容決定是否上訴，但消息人士認為有關判決僅為技術性決定，實際影響不大，與TVB最終是否受外地資本控制亦無關係。
